General terms of use

The current website at the address https://www.reynders.be (hereinafter the “Website”) is published and managed by the company Reynders NV, Centrum-Zuid 2049, 3530 Houthalen, BE 0411 630 683 (hereinafter “REYNDERS“).

Your visit to the Website and your navigation on the Website constitute acceptance of the present General Terms and Conditions of Use (hereinafter the “GTC“). By accessing the Website by any means (computer, mobile phone, tablet, etc.), the User declares to be aware of the current terms and conditions and to comply with them without reservations.

1. Definitions

The terms defined below have the following meanings, both singular and plural:

  • “Personal Data” means, according to Article 4, 1) of the Regulation EU 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), “any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, psychological, economic, cultural or social identity”. The Personal Data includes data by which Users can be identified.
  • “User” means any person who accesses the Website (e.g. visitors) and from whom Personal Data may be collected.
  • “Terminal” means various media that allow access to the Website. Terminals are in particular smartphones, tablets, Internet-based micro PCs (PC or Apple) and any object that is connected or can be connected to another object or to the Internet.

2. Purpose

The present GTC govern the conditions of access, provision and use of the Website, its functions and content by Users. A User who does not agree to the GTC may not access or use the Website.

The present GTC constitute a binding legal agreement applicable to Users who access the Website, navigate on the Website and use the Website in any manner.

REYNDERS collects Personal Data from Users in the context of their navigation on the Website.

4. Intellectual property

REYNDERS holds the domain name https://www.reynders.be.

The website and all elements of the website (whether or not animated images, illustrations, photos, sounds, know-how, texts, graphic elements, etc.), including software and databases (hereinafter the “Content“), are protected by intellectual property rights, in particular copyright, design and model rights, and trademark rights.

Unless otherwise stated, the intellectual property rights of the Content are the exclusive property of REYNDERS, another company of the group to which REYNDERS belongs, or a third party or partner that has granted REYNDERS the right to use it. REYNDERS does not grant any licences or sub-licences for all or part of the Content, nor any rights except the right to use the Website according to the terms in the current GTC.

The User acknowledges these rights and undertakes to comply with them. It is strictly prohibited to use, modify, copy, perform, display or translate all or part of the Content by any means without the prior written consent of REYNDERS or the holder of the protected element.

The unauthorised copying of literary, musical, audiovisual, photographic works, or works that may be protected by intellectual property rights and accessible via the Website is prohibited, under penalty of civil and/or criminal sanctions in accordance with the provisions of Book XI of the Code of Economic Law, unless the copy is exclusively for private purposes.

REYNDERS, or any other holder of these rights, may take the necessary measures or actions (judicial or otherwise) to put an end to such misuse of its intellectual property rights, and reserves the right to claim compensation in the event of such misuse.

5. Hyperlinks

The creation of links to the Website, “framing” of the Website, and more generally any use of an element of the Website must be authorised in advance in writing by REYNDERS, which may revoke such authorisation at any time.

REYNDERS does not manage all websites with hyperlinks to the Site. Consequently, REYNDERS does not accept any responsibility (in particular publisher responsibility) in relation to these websites.

7. RSS feeds

REYNDERS offers Users the possibility of subscribing to RSS feeds in order to be kept informed of articles or vacancies published on the Website. The feed is updated automatically or manually in Users’ web browser or messenger, depending on the subscription options chosen.

Users may unsubscribe from an RSS feed at any time by deleting it from their browser and/or messenger.

REYNDERS cannot collect information about Users through these RSS feeds. For technical reasons, REYNDERS only knows how many people have subscribed to an RSS feed.

8. Changes

When using the Website, the GTC in force at the time of use apply.

REYNDERS reserves the possibility of amending and updating the GTC without prior notice. To keep abreast of any changes, it is advisable to reread the GTC on a regular basis.

9. Conduct of Users

Users undertake to comply with the current CGUs.

More specifically, the Users undertake to behave in accordance with the provisions of the present paragraph, in particular by:

  • Not using a false identity to mislead others and providing false, surreptitious or incorrect contact details to REYNDERS;
  • Not causing harm to any person through the Website;
  • Not to post hyperlinks to the Website without the prior written consent of REYNDERS;
  • Not harm the reputation of REYNDERS or other Users through the Website;
  • Not disseminate content that is offensive, abusive, obscene, objectionable, violent or incites violence, content of a political, racist or xenophobic nature, or that generally goes against the laws and regulations in force, or against morals;
  • Not attempt to verify or test the vulnerability of the Website or violate security and authentication measures without authorisation;
  • Not disrupt or interrupt the Website or the servers and networks linked to the Website, and not violate the requirements, procedures, rules or regulations of the networks linked to the Website;
  • Not attempt to undermine the use of the services proposed on the Website;
  • Not disseminate personal, professional or confidential data that are unnecessary, sensitive or originating from third parties;
  • Not to process any personal data obtained on/through the Website, and in particular not to collect, misuse or otherwise harm the privacy or reputation of other Users or other natural or legal persons.

The Users must comply with the rules on intellectual property of the Website’s content, whether it concerns intellectual rights of REYNDERS or third parties.

If it appears that the GTC have been violated, REYNDERS may use any means at any time and in any manner to put an end to the User’s use of the Website, or to all or part of the services offered by the Website, without prior notice, without prejudice to the right to any damages that REYNDERS may claim from the User due to non-compliance with the current GTC.

10. Exclusion of liability

The User uses the Website at his own risk and declares that he is solely responsible for its use. It is up to the User to protect himself against the dangers of the Internet, and in particular to take the necessary measures to protect his data and/or software against possible viruses that may infect his computer or computer equipment. The User is solely responsible for the means of access to the Internet and the Website.

REYNDERS strives and deploys the necessary means to provide good quality information on the Website that is regularly updated. However, REYNDERS cannot guarantee the exactness and completeness of this information. Furthermore, the Website may be amended or modified without prior notice.

In the event of force majeure, technical or IT problems, problems relating to the structure of the telecommunications networks, maintenance or any other reason, access to the Website may be partially or fully suspended or discontinued if REYNDERS so decides.

If any of the provisions of the current GTC become null and void due to a change in the law, regulations or a court decision, this will not affect the validity and compliance of the other provisions in the GTC.

13. Applicable law and competent courts

The current GTC are subject to Belgian law.

FOR ANY DISPUTE RELATING TO THE EXISTENCE, INTERPRETATION, PERFORMANCE OR TERMINATION OF THE AGV BETWEEN REYNDERS AND THE USER, FOR WHICH NO AMICABLE SETTLEMENT CAN BE REACHED, ONLY THE COURTS OF BRUSSELS ARE COMPETENT, EVEN IN THE EVENT OF MULTIPLE DEFENDANTS. THIS GRANT OF JURISDICTION ALSO APPLIES IN THE EVENT OF MULTIPLE DEFENDANTS OR AN ACTION FOR INDEMNIFICATION, FOR EMERGENCY OR CONSERVATORY PROCEEDINGS BY REFERRAL OR BY PETITION.
